Terms and Conditions of the Cologne Museum Service

§ 1 Scope of Application
These Terms and Conditions apply to all events offered by Museumsdienst Köln. These include, for example, public tours, group tours, children’s birthday parties, holiday activities, workshops, courses, and projects.
§ 2 Conclusion of Contract / Registration
Museumsdienst Köln offers events that require registration and events that do not require registration (public events).
The contract for participation in events offered by Museumsdienst Köln that require registration is concluded upon the customer’s registration and confirmation by Museumsdienst Köln. Registration and confirmation may be made by telephone or in writing.
For events with a minimum number of participants, the contract is concluded subject to the condition precedent that the minimum number of participants is reached. The number of participants in events may be limited. For events requiring registration, registrations are processed in the order in which they are received.
Registrations for group tours must be received by the Cologne Museum Service at least ten days prior to the event date.
If a registration cannot be accepted, the Cologne Museum Service will notify the customer immediately.
For events for children and young people, age restrictions must be observed.
§ 3 Terms of Payment
The fee for the event organized by Museumsdienst Köln must be paid at the ticket office of the respective museum before the event begins.
In justified exceptional cases, payment by invoice may be arranged.
If a group rate has been agreed upon, the full amount of that fee remains due even if the number of participants decreases.
§ 4 Cancellation Policy (for events requiring registration)
Cancellations must be made in writing (e.g., email, letter, fax).
Registrations may be canceled free of charge up to five days before the event date.
If cancellation is not made in a timely manner, the full fee is due.
The same applies in the event of a no-show at the start of the event.
The date of cancellation is determined by the date of receipt by Museumsdienst Köln.
The burden of proof lies with the customer.
§ 5 Waiting Period
The waiting period for a Museumsdienst Köln employee is 15 minutes from the scheduled start of the event. The customer has no right to demand that the event take place after the waiting period has expired.
§ 6 Withdrawal by the Organizer
Museumsdienst Köln is entitled to withdraw from the contract with immediate effect for special reasons. This is particularly the case if the event must be canceled for reasons for which Museumsdienst Köln is not responsible (e.g., force majeure).
§ 7 Liability
Museumsdienst Köln is liable only in cases of intentional misconduct or gross negligence. This does not affect statutory liability for damages resulting from injury to life, limb, or health. In such cases, Museumsdienst Köln is liable regardless of the degree of fault.
§ 8 Set-off and Rights of Retention
Set-off against claims of Museumsdienst Köln is permitted only with respect to undisputed or legally established claims.
§ 9 Data Protection
All personal data is treated as confidential. Museumsdienst Köln is entitled to collect, store, and process all data necessary within the scope of the business relationship in accordance with the Federal Data Protection Act.
The customer authorizes Museumsdienst Köln to disclose this data to third parties commissioned to perform the contract, to the extent necessary for the fulfillment of the contract.
§ 10 Applicability of German Law
German law applies exclusively to the contractual relationship.
§ 11 Severability clause
The invalidity of individual sections of these General Terms and Conditions (GTC) shall not result in the invalidity of the entire terms and conditions.
§ 12 Final provision
These General Terms and Conditions of Museumsdienst Köln are effective as of August 1, 2011.
